The Short Version
This summary is here to help you read the document. It is not the agreement — the numbered sections below are.
- aēv provides wellness and educational information about your pet. We do not diagnose disease, prescribe treatment, or replace your veterinarian — and an aēv report is never a reason to delay veterinary care.
- Exams and lab work are performed by independent veterinary clinics and diagnostic laboratories. They are responsible for the clinical work; we provide the data and technology platform.
- Membership is annual and includes two Longevity Visits per year. Each visit is billed separately before it happens. You can cancel anytime.
- Refunds: cancel a scheduled visit at least 24 hours before the appointment for a full refund; after that, the visit is non-refundable.
- You own your data. We exchange it with your vet, and we use de-identified, aggregated data for research and product improvement — you can opt out of external research sharing.
- Disputes are resolved by individual arbitration, not in court and not as a class action. You may opt out of arbitration within 30 days — Section 14 explains how.
Agreement Notice
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and AevArk, Inc. (“AevArk,” “we,” “us,” or “our”). By accessing or using the AevArk platform, website, or services (together, the “Service”), you agree to be bound by these Terms. If you do not agree, do not use our services.
SECTION 14 CONTAINS A BINDING ARBITRATION AGREEMENT AND A CLASS-ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO A JURY TRIAL. YOU MAY OPT OUT WITHIN 30 DAYS AS DESCRIBED IN SECTION 14.6.
1. Description of Services
AevArk is a data and technology company. We operate a membership-based wellness and longevity platform for companion animals (dogs and cats) that connects pet owners with independent veterinary clinics and diagnostic laboratories. AevArk does not itself provide veterinary care, perform physical examinations, collect samples, or conduct diagnostic testing (see Section 2). Our services include:
- A membership program that arranges twice-yearly comprehensive longevity assessments (“Longevity Visits”) performed by independent participating veterinary clinics, including a detailed physical exam.
- Facilitating extensive blood, urine, and fecal laboratory testing performed by independent third-party veterinary diagnostic laboratories (such as Antech or IDEXX).
- Behavioral and cognitive questionnaires developed with veterinary researchers and practicing clinicians.
- Analysis and clear visualization of your pet's health data — tracking 120+ signals — so you can better understand your pet's health.
- AevArk Health Reports containing educational insights, trend analysis, and topics to discuss with your veterinarian — designed to empower you with data and make your veterinary visits more productive.
- Informational health scoring — including the Body Resiliency Score — based on clinical data (and, for cats, behavioral data).
- Educational materials on everyday habits and lifestyle — such as nutrition, movement, sleep, mental stimulation, dental care, and stress — that can help promote a longer, healthier lifespan for your pet.
- A digital platform for tracking your pet's health data over time.
- The exchange of health information with your designated veterinarian and veterinary clinic to support coordinated, informed care (see Section 9.3).
The specific tests, biomarkers, and report features included in the program are described on our website and may evolve over time (see Section 15).
2. IMPORTANT: Veterinary Disclaimer; Role of Independent Providers

AevArk's health reports, scores, insights, and recommendations — developed with input from practicing veterinarians and veterinary academics — are informational and educational tools ONLY. They do NOT constitute veterinary diagnosis, veterinary advice, treatment recommendations, or medical opinions of any kind.
AevArk is a data and technology company. AevArk is NOT a licensed veterinary practice and is NOT a diagnostic laboratory; it does not provide veterinary care or perform diagnostic testing. Our platform is designed to support — not replace — the professional judgment of your licensed veterinarian. No veterinarian-client-patient relationship is created between you and AevArk by using our website, platform, or reports.
All veterinary services — including physical examinations, sample collection, diagnosis, and treatment — are performed by independent, licensed veterinary clinics and veterinarians, and all laboratory testing is performed by independent diagnostic laboratories. These providers are independent third parties; they are not employees, agents, or representatives of AevArk. The quality and outcome of each veterinary examination are the sole responsibility of the veterinarian who performs it. The quality and outcome of laboratory work are the responsibility of the veterinarian and the diagnostic laboratories.
AevArk provides participating veterinarians with its veterinary examination requirements, based on the AVMA CAPE 25 gold standard, and makes reasonable efforts to ensure participating veterinarians follow them. However, completing the examination in accordance with those requirements remains the sole responsibility of the veterinarian. AevArk is not responsible for the acts, omissions, or professional judgment of any veterinary clinic, veterinarian, or laboratory.
ALWAYS consult a licensed veterinarian before making any health-related decisions for your pet. In an emergency, do not use AevArk. If your pet is in distress, contact your veterinarian or the nearest emergency animal hospital immediately. Never delay or disregard veterinary advice because of anything you see in the Service.
3. Limits of Testing; Assumption of Risk
3.1 What Results Can and Cannot Tell You
Before you enroll, you should understand the limits of health testing:
- A result is a snapshot. Biological values move with time of day, recent meals, exercise, stress, hydration, medication, illness, age, breed, and sex.
- Reference ranges are population-based. A value inside a range does not mean your pet is healthy, and a value outside a range does not mean your pet is ill.
- Our reports and scores are screening and educational tools, not diagnostic tests. They may reflect false positives or false negatives, cannot rule out disease, and do not detect all conditions. A reassuring report is never a reason to skip a veterinary visit or ignore a symptom.
- Assays can fail and results can be wrong. Laboratory error, sample degradation, mislabeling, and analytical variation happen. If we have reason to believe a result is unreliable, we will tell you and coordinate a re-test where we reasonably can.
- Turnaround times are estimates, not promises. Sample quality, shipping, re-runs, and laboratory capacity all affect them.
- Results can be unwelcome. A report may show something you were not expecting. We cannot tell you what it means for your pet — your veterinarian can.
3.2 About the Body Resiliency Score
The Body Resiliency Score and other AevArk health scores are statistical estimates, not measurements. They are derived from peer-reviewed veterinary research on aging in dogs and cats and reflect population-level associations observed in that research — not a direct measurement of your individual pet's biology. In particular:
- A score is meaningful only within the boundaries of the underlying research. If your pet falls outside the populations studied — for example by breed, age, or health condition — the score may be less reliable, or may not be available.
- A score is not an absolute or diagnostic value. It does not measure or predict how long your pet will live, and a change in a score is not by itself clinically meaningful. Every score carries a margin of error, and the underlying science is evolving.
- Do not make health, insurance, breeding, or purchase decisions based on a score alone. Use it as a starting point for a conversation with your veterinarian, not as a basis for action on its own.
- The methodology and underlying research for our scores are described on our website and may be updated over time (see Section 15).
3.3 No Promise of Outcomes
Nothing in the Service is a guarantee, warranty, or prediction that your pet will live longer, stay healthier, avoid any disease, or benefit from any recommendation.
3.4 Not a Monitoring or Alerting Service
We make reports available on the platform and tell you when they are ready. We do not monitor your pet's results on your behalf, and we are not a monitoring or alerting service. You are responsible for reviewing your pet's reports and for following up with your veterinarian about anything in them. If a result appears concerning, we and your veterinary clinic may make reasonable efforts to flag it and to reach you at the contact details on your account; this is a best-efforts courtesy, not a guarantee of delivery or timing. A flag is a prompt to seek professional care, not a diagnosis — and the absence of a flag is not clearance.
3.5 Sample Collection Risks; Your Responsibilities at Visits
Even when performed correctly, venipuncture and sample collection carry a small risk of bruising, hematoma, temporary discomfort, infection at the site, or stress, and rarely an animal reacts badly to handling or restraint. You accept these ordinary risks. The veterinarian may decline or stop a collection if, in their professional judgment, your pet is too stressed, fractious, unwell, or unsafe to handle; if that happens, the clinic will reschedule, or we will refund that visit if collection is not possible. You must disclose in advance any history of biting, aggression, fear-reactivity, or medical conditions affecting handling. You are responsible for your pet's behavior at all times during a Longevity Visit, and you agree to indemnify us under Section 12 for injury or property damage your pet causes.
3.6 Failed Samples
If a sample cannot be processed, we will coordinate a re-collection with your veterinary clinic. Re-collection made necessary by causes within AevArk's or the laboratory's control will be at no additional charge to you.
4. AI Features (When Available)
The Service may include AI-powered features, such as automated analysis of health data and a conversational assistant (“AI Features”). Some AI Features described on our website may not yet be available and will be introduced over time. When AI Features are made available:
- AI-generated content is produced automatically and may be incomplete, inaccurate, or outdated.
- Unless we expressly state otherwise, AI-generated content is not reviewed by a veterinarian before it is shown to you. We may review AI outputs on a sample basis for quality assurance of the product as a whole; that is not a review of your pet's report or of any particular response.
- AI-generated content is educational and wellness information only and is never veterinary advice. Confirm any AI-generated information with your licensed veterinarian before acting on it.
- Do not submit sensitive personal information about yourself or other people through AI Features.
5. Eligibility
To use AevArk's services, you must:
- Be at least 18 years of age.
- Reside in the United States. The Service is offered only in the U.S., and Longevity Visits are available only where our participating clinics and laboratories operate.
- Be the legal owner of, or have authorized responsibility for, the companion animal(s) whose data you submit.
- Have the legal capacity to enter into a binding agreement.
- Provide accurate and complete information during registration and use.
By creating an account, you represent and warrant that you meet all eligibility requirements.
6. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate, current, and complete information when creating your account.
- Promptly update your information to keep it accurate.
- Notify us immediately at legal@aevark.com of any unauthorized access to or use of your account.
- Not share your account credentials with any third party.
AevArk will not be liable for any loss or damage arising from your failure to protect your account credentials.
7. Membership, Fees, and Payment
7.1 Membership Plans
AevArk offers an annual membership that includes two Longevity Visits per year. The clinical components of each Longevity Visit are delivered by independent veterinary clinics and diagnostic laboratories (see Section 2); AevArk provides the platform, data analysis, reporting, and coordination services. Current pricing and plan details are available on our website at www.aevark.com. Optional add-on tests or services — offered based on your pet's breed, age, and risk profile — may be available at additional cost. Any treatments, procedures, or services provided by your veterinarian outside the aēv program are separate from your membership and are payable directly to the veterinary provider.
7.2 Billing and Renewal
By joining, you authorize AevArk to charge your payment method through our payment processor (Stripe). Each Longevity Visit is billed separately, in advance of the visit, at the then-current per-visit price. All fees are in U.S. dollars and are non-refundable except as expressly stated in these Terms. Your membership continues from year to year unless you cancel. We will:
- Disclose the recurring nature of the membership, the billing cadence, and how to cancel, clearly and conspicuously before you buy, and obtain your affirmative consent to recurring billing separately from the rest of the purchase.
- Send you a billing reminder email at least 7 days before charging you for an upcoming Longevity Visit, to the email address associated with your account.
- Give you at least 30 days' notice of any price increase. An increase applies only to future billing, and you may cancel before it takes effect.
If a payment fails, we will notify you, may retry the charge, and may suspend access to your account until the payment is resolved. If you dispute a charge with your bank rather than contacting us first, we may suspend the Service while the dispute is open — email us first and we can usually resolve it faster.
7.3 Cancellation and Refunds
You may cancel your membership at any time through your account settings. Cancellation stops all future Longevity Visit charges.
- You may cancel a scheduled Longevity Visit for a full refund of that visit's charge if you cancel at least 24 hours before the scheduled appointment time.
- Cancellations made less than 24 hours before the scheduled appointment time, and visits that have already been performed, are non-refundable, except where required by applicable law.
- If we fail to deliver — we cannot arrange a visit in your area, a sample fails for a reason within our or the laboratory's control and cannot be replaced, or we cannot deliver your results — you will receive a full refund for the affected visit.
Nothing in this section limits refund or cancellation rights your state's law gives you. Where state law gives you a stronger right, that right applies.
8. Acceptable Use
You agree to use AevArk's services only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Submit false, inaccurate, or fabricated pet health data, or submit a sample from an animal you do not own or have authority over.
- Use the platform for any commercial purpose other than your personal pet health management without written authorization from AevArk.
- Attempt to reverse-engineer, decompile, or extract the source code of our platform, algorithms, or software.
- Use automated means (bots, scrapers) to access or collect data from our platform.
- Probe, scan, or test the security of our systems, or circumvent authentication, rate limits, or access controls.
- Use the Service, or any data, reports, or insights derived from it, to build a competing product or service, or to train machine-learning or artificial-intelligence models.
- Interfere with or disrupt the integrity or performance of our services.
- Use our services in any manner that could harm, disparage, or create liability for AevArk.
- Violate any applicable local, state, federal, or international laws or regulations.
- Submit data for companion animals you do not own or for which you do not have authorized caregiving responsibility.
- Resell, redistribute, or commercialize AevArk reports or insights without written authorization from AevArk.
- Harass, threaten, or abuse AevArk staff or participating veterinary professionals.
We may investigate suspected violations and suspend or terminate accounts involved.
9. Intellectual Property and Your Data
9.1 AevArk's IP
All content, software, algorithms, reports, designs, trademarks, and materials on the AevArk platform are owned by or licensed to AevArk and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use our services for your personal, non-commercial use. You may view, download, print, and share your pet's reports for personal, non-commercial purposes, including sharing them with any veterinarian.
9.2 Your Data; Ownership
You retain full ownership of the personal data and pet health data you submit to AevArk or that is collected through the aēv program. By using our services, you grant AevArk: (a) a limited license to process, analyze, and use your data to provide our services to you; (b) the authorizations to exchange your data with your veterinary care team as described in Section 9.3; (c) permission for review of clinical data as described in Section 9.4; and (d) a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to de-identify and aggregate your data and to use such de-identified, aggregated data for the purposes described in Section 9.5. AevArk will not sell your identifiable personal data or use it in ways inconsistent with our Privacy Policy.
9.3 Sharing With Your Veterinary Care Team
Coordinated care is central to the aēv program. By enrolling, you authorize AevArk to both receive and share health information with your designated veterinarian, participating veterinary clinics, and the diagnostic laboratories that process your pet's samples. This includes: (a) receiving laboratory results, physical exam findings, clinical notes, and visit summaries from your veterinarian and laboratory providers; and (b) sharing your pet's AevArk Health Reports, scores, trends, and recommendations with your designated veterinarian and veterinary clinic to support ongoing, informed care. You may change your designated veterinarian at any time through your account settings or by contacting us.
9.4 Clinical Advisory and Steering Committee Review
To maintain clinical quality and improve our protocols, pet health data may be reviewed by members of AevArk's veterinary steering committee and clinical advisory board. Committee members and advisors are bound by confidentiality obligations and access data only as needed for clinical review, protocol development, and quality assurance.
9.5 Research and Commercial Collaboration
AevArk collaborates with academic and research institutions and select commercial partners to advance veterinary science and improve our products and services. Data shared with external research or commercial partners is limited to de-identified and aggregated data — data from which information identifying you or your companion animal has been removed. Such de-identified and aggregated data may be used for purposes including veterinary research, development and validation of health algorithms and reference ranges, and improvement of AevArk's and its partners' products and services. You will not receive compensation for any research, publication, or product that results from de-identified data. You may opt out of the sharing of de-identified data with external research partners at any time by emailing privacy@aevark.com, without affecting your membership. AevArk will not share your name, contact information, or other identifiable personal data with external research or commercial partners without your explicit consent.
10. Limitation of Liability; Disclaimer of Warranties
LIMITATION OF LIABILITY — PLEASE READ
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AEVARK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, ADVISORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE OUR SERVICES.
AEVARK IS A DATA AND TECHNOLOGY PLATFORM ONLY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AEVARK SHALL NOT BE LIABLE FOR ANY ACTS, OMISSIONS, NEGLIGENCE, OR PROFESSIONAL MALPRACTICE OF ANY INDEPENDENT VETERINARY CLINIC, VETERINARIAN, DIAGNOSTIC LABORATORY, OR OTHER THIRD-PARTY PROVIDER. SUCH PROVIDERS RENDER THEIR SERVICES UNDER THEIR OWN PROFESSIONAL LICENSES AND RESPONSIBILITY, AND ANY CLAIM ARISING FROM VETERINARY CARE OR LABORATORY TESTING MUST BE BROUGHT AGAINST THE PROVIDER THAT PERFORMED IT.
IN NO EVENT SHALL AEVARK'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU PAID TO AEVARK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
These limitations do not apply to liability that cannot be limited by law, including liability arising from AevArk's own gross negligence, willful misconduct, or fraud. Some states do not allow certain exclusions or limitations, so parts of this section may not apply to you; in those states, our liability is limited to the smallest amount permitted by law.
THE AEVARK PLATFORM AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, AEVARK DOES NOT WARRANT THAT: OUR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; ANY TEST RESULT, SCORE, OR RECOMMENDATION IS ACCURATE, COMPLETE, OR RELIABLE; THE SERVICES WILL DETECT, PREVENT, PREDICT, OR DELAY ANY DISEASE OR CONDITION; OR THAT USING THE SERVICES WILL IMPROVE, EXTEND, OR PRESERVE YOUR PET'S HEALTH OR LIFESPAN. AI-GENERATED CONTENT, WHERE AVAILABLE, IS PROVIDED “AS IS” AND WITH ALL FAULTS (SEE SECTION 4).
11. Third-Party Services
The Service relies on third parties — payment processing, veterinary clinics, laboratories, shipping, and communications providers. Their terms and privacy policies govern what they do, and we are not responsible for them. Links from our website are not endorsements.
12. Indemnification
You agree to indemnify, defend, and hold harmless AevArk and its officers, directors, employees, advisors, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any data you submit to our platform; (e) injury to any person or animal, or damage to any property, caused by your pet, including during a Longevity Visit or sample collection; or (f) your misrepresentation of your pet's health, vaccination status, or behavioral history.
13. Termination
AevArk reserves the right to suspend or terminate your access to our services if you breach these Terms, if we are required to by law, if your payment fails, or if your conduct puts our staff, participating veterinary professionals, another customer, or an animal at risk. If we terminate without cause, we will refund any amount charged for a Longevity Visit that has not yet taken place. You may delete your account at any time by contacting legal@aevark.com.
Ending your membership does not delete your pet's reports. Results you have paid for remain yours, and you may request a copy at any time by emailing legal@aevark.com.
The following sections survive termination: 2, 3, 9, 10, 11, 12, 14, and 17.
14. Governing Law and Dispute Resolution
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Nothing in this section deprives you of the protection of mandatory consumer-protection laws of the state where you live.
14.2 Informal Resolution First
Before starting an arbitration, you agree to email legal@aevark.com with a short description of the dispute and what you want, and to give us 60 days to resolve it. We will do the same before bringing a claim against you. This step is a condition of starting arbitration, and applicable limitations periods are tolled while it runs.
14.3 Agreement to Arbitrate
If we cannot resolve a dispute informally, you and AevArk agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules, before a single arbitrator, and not in court. The Federal Arbitration Act governs this section. For claims under $10,000, AevArk will pay the JAMS filing, administration, and arbitrator fees, unless the arbitrator finds your claim frivolous.
14.4 Exceptions
Either party may: bring an individual claim in small-claims court if it qualifies; or seek injunctive or other equitable relief in a court of competent jurisdiction to stop actual or threatened infringement or misuse of intellectual property. Nothing in this section prevents you from reporting a matter to a government agency.
14.5 Class-Action and Jury Waiver
YOU AND AEVARK EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may award relief only to the individual party seeking it, and only to the extent needed to remedy that party's own claim. If this waiver is found unenforceable as to a particular claim or form of relief, that claim or relief shall be severed and heard in court, while all other claims remain in arbitration. A court, not the arbitrator, decides the enforceability of this paragraph.
14.6 Your Right to Opt Out
You may opt out of arbitration under this Section 14 within 30 days of first accepting these Terms by emailing legal@aevark.com with the subject line “Arbitration Opt-Out,” stating your name and the email address on your account. Opting out does not affect your membership, your price, or any other part of the Service. If you opt out, disputes will be resolved in the state or federal courts located in Delaware, and you consent to their exclusive jurisdiction.
14.7 Coordinated Filings
If 25 or more similar claims are brought against AevArk by or with the assistance of the same law firm or coordinated group, the claims will be filed and resolved in batches of no more than 50, each batch heard by a single arbitrator, and neither side may proceed to the next batch until the current one is resolved. All applicable limitations periods are tolled for claims awaiting a batch.
14.8 Survival and Severability
This Section 14 survives termination. If any part of it other than Section 14.5 is found unenforceable, the remainder stays in force.
15. Changes to Our Services
AevArk's platform is designed to evolve. The specific biomarkers, laboratory panels, diagnostic tests, lab providers, report components, and health metrics included in our services are periodically updated to reflect advances in veterinary science, clinical best practices, recommendations of AevArk's advisory board and steering committee, changes made by the diagnostic laboratories we work with, and operational considerations. We do not guarantee that any specific panel, biomarker, laboratory provider, or report feature shown on our website or in sample materials will be included in any given report or service at the time of your subscription.
Any sample health reports, biomarker panels, or laboratory references displayed on our website are for illustrative purposes only and are subject to change without notice. Such changes do not constitute a material modification of these Terms and do not entitle you to a refund. If a change materially reduces the benefits you have already paid for, we will tell you and you may cancel the affected visit for a refund of its unused charge.
16. Changes to These Terms
We may update these Terms from time to time. We will provide reasonable notice of material changes — at least 30 days where practicable — by posting the updated Terms on our website or sending you an email. Your continued use of our services after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not accept a material change, you may cancel before it takes effect.
17. General Provisions
Electronic communications and signatures. You consent to transact with us electronically and to receive agreements, disclosures, billing notices, receipts, and other required notices at the email address on your account. Your click or typed name constitutes your legally binding signature under the federal E-SIGN Act and comparable state laws.
Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, including natural disaster, epidemic or epizootic disease, labor disruption, carrier failure, laboratory or clinic closure, war, and failures of infrastructure or third-party services.
